INFORMATIVE WEBSITE IN ACCORDANCE WITH NATIONAL LEGISLATION AND ARTICLE 13 OF EU REG. 2016/679
1. DATA CONTROLLER
Pursuant to Arts. 4 and 24 of EU REG 2016/679, the Data Controller is Gambini Meccanica srl, with registered office at Strada dei Cacciatori 38, 61122 Pesaro (PU), Tel. +39 0721 282667, firstname.lastname@example.org in the person of its legal representative pro tempore This information is issued according to the principles of Art. 13 of EU Reg. 2016/679 “Data obtained from the interested party”.
2. PURPOSE AND LEGAL BASIS OF THE PROCESSING
The personal data provided will be processed in compliance with the conditions of lawfulness of Art. 6 of EU Reg. 2016/679 for the following purposes:
a) Filling out a form to request information from the company;
b) Subscription to the newsletter, for receiving information and commercial promotions via email;
c) Registration request to access the sizing calculation system;
For item a) the legal basis of the processing is a legitimate interest (Article 6 paragraph 1 letter f). For points b) and c) the legal basis of the processing is the explicit consent of the user (Art. 6 paragraph 1 letter a).
3. DURATION OF DATA RETENTION
The data collected will be processed by manual, computerised or telematic means, with respect for the purposes for which they were collected and in a manner that guarantees their security and confidentiality. The personal data will be kept for the period of time necessary for the specific fulfilment of the aforementioned purposes, also taking into account the respect of the times imposed by the law for purposes of judicial protection of the interests of the User and of the Owner. Therefore, in compliance with the provisions of Art. 5 paragraph 1 letter e) of EU Reg. 2016/679, the storage of personal data provided depends on the purpose of the processing: for contact request data, the storage time is up to 6 months, for registration to the newsletter and to the calculation system for sizing up revocation of consent.
4. DATA RECIPIENTS OR CATEGORIES OF RECIPIENTS
The personal data provided will be communicated to recipients, who will process the data as data processors (Art. 28 of EU Art. 2016/679) and/or as natural persons acting under the authority of the Controller and the Manager (Art. 29 of EU EU 2016/679), for the purposes listed above in point 2. The data may be made available to:
a) subjects that provide services for the management of the information system and telecommunications networks, including e-mail and the website;
b) freelancers, firms or companies in the field of assistance and consulting;
c) competent authorities for the fulfilment of obligations under laws and/or provisions of public bodies, upon request;
The subjects belonging to the above categories are responsible for data processing, or operate in total autonomy as separate data controllers.
5. DATA TRANSFER TO A THIRD COUNTRY
The Data Controller may transfer your personal data to a third country or to an international organization located within the European Union. However, the right to use cloud services is reserved; in this case, the service providers will be selected from among those who provide adequate guarantees, as required by Art. 46 GDPR 679/16. 2016/679.
6. NATURE OF THE PROVISION AND REFUSAL
Apart from that specified for browsing data, the user is free to provide personal data. The provision of data is optional or mandatory depending on the specific purpose for which the data is processed. Failure to provide the data marked with the * symbol will make it impossible to obtain what is requested or to use the services of the Data Controller.
7. RIGHTS OF INTERESTED PARTIES
You may exercise your rights as expressed in Arts. 15, 16, 17, 18, 19, 20, 21, 22 of EU Regulation 2016/679, by contacting the Data Controller at email@example.com. You have the right, at any time, to ask the Data Controller for access to your personal data, rectification or deletion of the same, as well as the limitation of processing. Further, you have the right to object, at any time, to the processing of your data (including automated processing, e.g. profiling), as well as to the portability of your data. Without prejudice to any other administrative or jurisdictional appeal, if you believe that the processing of data concerning you violates the provisions of EU Reg. 2016/679, in accordance with Article 15, letter (f) of the aforementioned EU Reg. 2016/679, you have the right to file a complaint with the Guarantor for the protection of personal data and, with reference to Art. 6 paragraph 1, letter a) and Art. 9, paragraph 2, letter a), have the right to revoke the consent given at any time. In the event of a request for data portability, the Data Controller will provide the personal data concerned in a structured format, commonly used and readable, by automatic device, without prejudice to paragraphs 3 and 4 of Art. 20 of EU 2016/679.
